May 9 cases transfer case; Written decision to reject Punjab government’s request – Pakistan

The Supreme Court has issued a written decision to reject the Punjab government’s request for transfer of cases on May 9.

According to the written decision, the Chief Justice has the authority to protect the judicial officers from interference, the reference against the ATC judge has been inadequate evidence, personal comments will not affect the upcoming proceedings.

The Supreme Court dismissed the transfer of cases due to a shortage of evidence, the court said that the remarks of the Chief Justice High Court are under administrative jurisdiction, the anti -terrorism court has not been accused of prejudice.

The written decision also stated that the transfer of the Chief Justice was not right to proceed, the Chief Justice considered it his constitutional duty to protect the judicial officers, whether the remarks, whether critical or complimentary, should not be considered final in the future.

According to the judicial decision, the definition does not grant an officer an exception to accountability.

The Punjab government had filed a reference against former ATC Judge Ijaz Asif, the Lahore High Court dismissed the reference and transfer petition.
